Before the Most Noble and Right Honourable the Lords Commissioners of Appeals in Prize Causes. An appeal from the Vice-Admiralty Court of Jamaica. De Staadt Trieste, Jean Joseph Hyvert, Master. The said Jean Joseph Hyvert, the Master, described as a Burgher, and late an Inhabitant of Ostend, the Claimant on Behalf of Messrs. Famin & Regoult, described Burghers, Merchants, and Inhabitants of the said City of Ostend, and Subjects of his Imperial Majesty the Emperor of Germany, as Owners and Proprietors of the said Ship Staadt Trieste, her Tackle, Apparel, and Furniture, and all and singular the Goods, Wares, and Merchandizes laden therein. Also on Behalf of himself, Peter Leroux, the First Mate; Andrew Fassey, the Second Mate, and Charles Duclos, Third Mate, all described Burghers and late Inhabitants of Ostend aforesaid, as Owners of sundry Goods, their private Adventure; and on Behalf of Mons. Dumoulin, described a Burgher, and late an Inhabitant of the Bishoprick of Liege in Germany, a Passenger, as Owner of sundry Goods laden in said Ship, - - - Appellant, against William George Fairfax, Esq. Commander of his Majesty's Ship of War the Tartar, and Benjamin Hulke, Esq. Commander of his Majesty's Ship of War Du Quay Trouin, their respective Officers and Mariners, Captors of the said Ship and Goods, Respondents. Appendix to the Respondents' Case.
